Taco Bell Salmonella Outbreak Lawsuits and Litigation
On August 6, 2010, Marler Clark filed the first Salmonella lawsuit connected to the multi-state outbreak of Salmonella linked to Taco Bell restaurants on behalf of Kentucky resident Jo Ann Smith. The lawsuit was filed in Kentucky, against Yum Brands, Inc., parent company of Taco Bell. The case, number 10-CI-1260, was filed in Franklin County Circuit Court. The CDC is investigating outbreaks of Salmonella linked to a Mexican fast food chain, which Washington State named as Taco Bell on August 5.
Two strains of Salmonella are implicated - Salmonella Hartford and Salmonella Baildon. The Salmonella Hartford outbreak caused 75 illnesses in 15 states since April 1. The involved states are Colorado, Georgia, Illinois, Indiana, Kentucky, Massachusetts, Michigan, Montana, North Carolina, New Hampshire, New York, Ohio, Pennsylvania, South Carolina and Wisconsin. The Salmonella Bialdon outbreak caused 80 illnesses since May 1, 2010. The states involved with that strain are Connecticut, Georgia, Illinois, Indiana, Iowa, Kentucky, Massachusetts, Michigan, Minnesota, New Jersey, New York, Ohio, Oregon, Washington, and Wisconsin.
On August 17, Marler Clark filed a second lawsuit on behalf of an Ohio resident infected with Salmonella Hartford after eating at Taco Bell.
On February 2, 2011 Marler Clark filed its third lawsuit in Michigan Circuit Court on behalf of a Whitehall, Michigan man who contracted Salmonella Baildon after eating at a local Taco Bell.
